Abstract
Este artículo permite pasar revista a la forma en que ha venido evolucionado la construcción de la legislación forestal en los países tropicales. Se identificaron factores que limitan o favorecen el cambio en el establecimientode esquemas de gobernanza multiactoral, tanto a nivel nacional como subnacional. Para la buena gobernanza forestal se deben considerar aspectos y mecanismos fundamentales que permitan llegar a acuerdos en formaparticipativa, representativa y legítima, con una amplia apropiación por parte de los actores competentes directos e indirectos del sector forestal. Con el fin de ampliar el contexto de discusión, se incluyen esquemas degobernanza a escalas más globales, que persiguen tanto la conservación de bosques como la legalidad del uso y comercio de productos forestales a nivel internacional. Una gobernanza forestal multiactoral fortalecida sin dudacontribuye a mejorar la credibilidad de la institucionalidad forestal, a alcanzar acuerdos que respeten los derechos de los actores relacionados con los bosques, a crear incentivos económicos y a reducir los costos de transacciónpara mantener la competitividad de los negocios forestales y atraer inversión que dinamice una economía forestal inclusiva y propicie la conservación, la regeneración y rehabilitación de los bosques y otros sistemas productivos de base forestal.
This article reviews the way in which construction of forest legislation in tropical countries hasbeen evolving. Factors that hamper or favor change inputting multiactor governance structures in place areidentified, both at the national and subnational level.For good forest governance, fundamental aspectsand mechanisms should be contemplated that enableagreements to be reached in a participatory, representative and legitimate manner, with broad appropriation by relevant direct and indirect forestry-sectoractors. In order to expand the context of the discussion, more-global schemes of governance are included that seek both forest conservation and legalityof use and trade of forest products at the international level. Strengthened multiactor forest governanceundoubtedly contributes to improving the credibility offorestry institutionality, reaching agreements that respect the rights of actors involved with forests, creatingeconomic incentives that reduce transaction costs tomaintain competitiveness of forestry businesses, andattracting investments that boost an inclusive foresteconomy and encourage conservation, regenerationand rehabilitation of forests and other forest-basedproductive systems.
