La propuesta investigativa que se encara se traduce en una invitación para variar el statu quo existente en Costa Rica acerca de la forma de comprensión habitual del daño moral. En esa línea, luego de repasar la senda jurisprudencial de la Sala Primera de la Corte Suprema de Justicia, donde se denota alguna inadvertida evolución de esta respuesta indemnizatoria, se matizará el análisis con profundos aportes que, en este particular, ha brindado el derecho comparado.
