La obligación de la interpretación conforme a la Convención Americana de Derecho Humanos

Abstract

El presente estudio tiene como finalidad analizar la técnica de la interpretación conforme a la Convención Americana de Derechos Humanos. En particular, se tratarán los antecedentes históricos, el fundamento normativo y las características de esta técnica interpretativa. Además, se analizará el vínculo de la interpretación conforme en sede nacional, concretamente en Costa Rica y México, así como los desafíos que tienen los jueces nacionales como impulsores de ese instrumento de diálogo jurisprudencial cuya finalidad es la creación de estándares mínimos de tutela.

This study pretends to analyse the technique of interpretation according to the American Convention on Human Rights. We will deal particularly with the historic background, the normative justification and the characteristics of this interpretative method. Moreover, we will analyse the connection of the technique in the domestic venue, concretely in Costa Rica and Mexico, as well as the challenges of national judges as promoters of this instrument of jurisprudential dialogue which has the objective of creating minimum standards of protection.
