Abstract
En Costa Rica, el resarcimiento del daño en materia contenciosa administrativa y civil de haciendo es limitado y la forma de resarcimiento actual no satisface el mandato de resarcimiento integral del daño contenido en la carta magna. Con un enfoque en la persona y no en su patrimonio, para satisfacer la actual insuficiencia, se ha planteado la idea de un proyecto de ley que persigue introducir el resarcimiento del daño existencial y garantizar el acceso a la justicia contencioso-administrativa a personas con menor capacidad económica. Como respaldo a la propuesta se han tomado datos cuantitativos del Poder Judicial, así como cualitativos con base en doctrina y experiencias en otros países a través de métodos como el hermenéutico y análisis de contenido.
In Costa Rica, compensation for damage in contentious administrative and civil matters is limited and the current form of compensation does not satisfy the mandate for comprehensive compensation for damage contained in the Magna Carta. With a focus on the person and not on their assets, to satisfy the current insufficiency, the idea of a bill has been proposed that seeks to introduce compensation for existential damage and guarantee access to contentious-administrative justice for people with less economic capacity. To support the proposal, quantitative data has been taken from the Judiciary, as well as qualitative data based on doctrine and experiences in other countries through methods such as hermeneutics and content analysis.
