El proceso penal está compuesto por una serie de etapas. Una inicial o de investigación, otra intermedia, una de juicio y finalmente una de ejecución penal. El problema se concentra en que esta última etapa
es tradicionalmente olvidada. Se llega hasta la etapa de juicio, en algunos casos con una fase recursiva, pero luego de ello se olvida todo; y lo cierto es que es posible que la etapa de ejecución de la pena sea una de las más delicadas de todo el proceso, en el tanto se pasa del plano teórico de la aplicación del Derecho Penal, al plano práctico, a la realidad del mismo en conjunto con la puesta en escena del Derecho Penitenciario. La invisibilización de esta etapa ha provocado en muchos casos la violación impune de derechos humanos.
The criminal procedure consists of a number of stages comprising: Initial investigation, intermediate, trial, and criminal enforcement. The problem focuses in that last of these stages, as it has been traditionally neglected. Thus, the trial stage is reached, in some cases with an appeal phase, but after that, everything is disregarded. The truth is that the criminal enforcement stage is probably one of the most delicate in the entire process, as it goes from the theoretical level of the application of Criminal Law to a practical level, to its reality along with the involvement of Penitentiary Law. The invisibility of this stage has caused, in many cases, unpunished violation of human rights.
