El delito como manifestación del poder, derecho de los vencedores y la memoria histórica en Walter Benjamin

Abstract

El presente artículo se fundamenta en el concepto de “memoria” de Walter Benjamin y sus tesis sobre el concepto de la historia. Se pretende lograr por medio de un análisis de algunas de estas tesis una delimitación del concepto de delito como manifestación de poder del Estado, concibiendo el proceso de formación de la ley y del delito mismo, desde la perspectiva de los vencedores. No se ocupa el trabajo en general de todas las tesis del concepto de la historia de Walter Benjamin, sino únicamente de las denominadas tesis VIII, IX y X.

This article is based in the concept of “memory” of Walter Benjamin and your thesis about the concept of the history. It pretend reach through an analysis of some of these thesis an delimitation of the concept of crime like manifestation of the State power, conceiving the formation process of the law and the crime itself, from the perspective of the victors. Doesn’t address the work in general of all these thesis of history concept by Walter Benjamin, but only the named thesis VIII, IX and X.
