El respeto a la voluntad del tutelado en el Derecho Japonés

Abstract

Para hacer frente a un fenómeno de envejecimiento poblacional, el sistema japonés de protección al mayor de edad discapacitado fue reformado en el año 1999, introduciendo nuevo sistema de protección: la asistencia, añadiéndolo a la curatela y la tutela. A su vez, se introdujo un sistema de tutela voluntaria con miras a permitir al tutelado una mayor participación en el manejo de sus negocios.

To deal with the issue of aging population, the Japanese system to protect disabled adults was reformed in 1999, by adding a new type of protection, assistance, to tutorship and guardianship. Furthermore, a new system of voluntary guardianship was introduced to allow the subjects of such guardianship to better participate in the administration of their affairs.
