Apuntes sobre la perspectiva de género en el Derecho Penal

Abstract

El presente trabajo trata el tema del papel de la perspectiva de género en el derecho. Esto lo hace basándose en la tendencia de invisibilización hacia el género femenino en el derecho penal, es decir, la poca consideración que este ha tenido en el plano normativo. Por esta razón, el artículo plantea la importancia que tiene la incorporación de esta perspectiva en la construcción jurídica como una herramienta para que se tomen en cuenta las diferencias entre las mujeres y los hombres que son componentes de su individualidad. Así como, la falla que ha tenido el sistema al ignorarlas históricamente.

This paper approaches the issue of the role of gender perspective in Law. The analysis is based on the tendency toward the invisibility of the female gender in criminal law, that is, the limited consideration that this gender has received in the normative scope. Therefore, this article sets out the importance of incorporating this perspective into the legal construction, as a tool for taking into account the differences between men and women, which make up their individuality. Moreover, it presents the failure of the system that has neglected this issue historically.
