Abstract
En el presente estudio se analiza la noción de judicial
dialogue en el ámbito de la protección multinivel de los derechos
fundamentales en América Latina. En particular se estudiarán las
diferentes tipologías, características y elementos fundamentales de este
fenómeno con fundamento en la doctrina y la jurisprudencia más relevante
en la materia. Posteriormente se analizará la relación que existe entre la
Sala Constitucional de la Corte Suprema de Justicia de Costa Rica y la
Corte Interamericana de Derechos Humanos
This article focuses on the notion of judicial dialogue in light of the multilevel system of protection of fundamental rights in Latin America. More particularly, the typologies, characters and defining elements of this phenomenon will be considered building on relevant scholarly works and case law. Subsequently, the paper will analyse the relationship between the Constitutional Chamber of the Supreme Court of Justice of Costa Rica and the Inter-American Court of Human Rights.
