La ubicuidad del lenguaje jurídico en la vida cotidiana de la ciudadanía y su naturaleza de
lenguaje especializado, que lo ha hecho inaccesible a la comprensión del individuo ajeno a la
práctica jurídica, ha impulsado diversas directrices de parte de los poderes judiciales y esferas
ligadas al derecho para hacer más accesible el lenguaje de los textos jurídicos, orales o escritos,
a la ciudadanía. Sin embargo, aunque existe la intención de facilitar el acceso a la justicia al
público costarricense, no ha habido en nuestro país estudios que aborden, de manera
específica, la inteligibilidad (o su ausencia) del lenguaje jurídico costarricense. La presente
investigación aborda esta problemática a través de un método de dos fases: primero, un análisis
lingüístico-estructural y genérico-discursivo de dos géneros jurídicos, uno escrito y otro oral,
de uso común por parte de la ciudadanía costarricense, con el objetivo de determinar sus
características específicas; y segundo, dos pruebas de comprensión del lenguaje jurídico, una
en la modalidad escrita, aplicada en un solo momento y lugar a un público seleccionado, y la
otra en modalidad oral, a los participantes auténticos en audiencias civiles, aplicada justo
después de la realización de cada audiencia. Al final de la investigación, se aclara que el ámbito
de análisis y de prueba de comprensión ha sido muy limitado y se precisa de más estudios en
este tema, por lo que los resultados no pueden ser tomados como definitivos. Hecha esta
aclaración, se constata que los géneros jurídicos presentan efectivamente las características
previsibles por la doctrina de géneros profesionales con uso de lenguaje técnico especializado.
En las pruebas aplicadas, se constata que el léxico especializado ha sido el factor que más
dificultades ha presentado para la comprensión por parte del público ajeno al derecho.
También se observa que una notable insuficiencia en estrategias lectoras y en conocimientos
lingüísticos del lenguaje no especializado ha significado un importante obstáculo para la
comprensión de los textos sujetos a examen. En la conclusión, se insta a continuar los
esfuerzos por clarificar el lenguaje jurídico expuesto al público ajeno al derecho; asimismo,
se recomienda formar a los profesionales del derecho en estrategias comunicativas para
facilitar la información debida a sus clientes; y finalmente, se hace un llamado a fortalecer las
estrategias de lectura y comprensión generales en la ciudadanía. The ubiquity of legal language in the daily life of citizens and its nature as a specialized
language, which has made it inaccessible to the understanding of the individual outside of
legal practice, has prompted various guidelines from the judiciary and spheres linked to law
to make the language of legal texts, oral or written, more accessible to the public. However,
although there is an intention to facilitate access to justice for the Costa Rican public, there
have been no studies in our country that specifically address the intelligibility (or lack thereof)
of the Costa Rican legal language. The present investigation approaches this problem through
a two-phase method: first, a linguistic-structural and generic-discursive analysis of two legal
genres, one written and the other oral, commonly used by the Costa Rican citizens, with the
objective of determining its specific characteristics; and second, two comprehension tests of
legal language, one in the written modality, applied at a single time and place to a selected
public, and the other in oral modality, to the authentic participants in civil hearings, applied
just after the completion of each audience. At the end of the investigation, it is clarified that
the scope of the analysis and comprehension test has been very limited, and more studies are
needed on this subject, so the results cannot be taken as definitive. Having made this
clarification, it is verified that the legal genres effectively present the characteristics
(foreseeable by the doctrine) of professional genres with the use of specialized technical
language. In the tests applied, it is verified that the specialized vocabulary has been the factor
that has presented the most difficulties for understanding by the public outside the law. It is
also observed that a notable insufficiency in reading strategies and in linguistic knowledge of
the non-specialized language has meant a significant obstacle to the understanding of the texts
under examination. In the conclusion, it is urged to continue the efforts to clarify the legal
language exposed to the public outside the law; likewise, it is recommended to train legal
professionals in communication strategies to provide the necessary information to their clients;
and finally, a call is made to strengthen general reading and comprehension strategies among
citizens.
